Terms of Use

These terms are an agreement between you and Multimode Technologies ("we", "us") about the Terraform Tycoon game. By playing you accept them. On iOS, your license to the app is also governed by Apple's Licensed Application End User License Agreement (the "Apple EULA"). These terms add to the Apple EULA; if they conflict, the Apple EULA wins for the license to the app itself. Our Privacy Policy explains how we handle data.

1. Playing the game

The game is free to download and play. You may use it for personal, non-commercial entertainment. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you and is responsible for your purchases. Your progress is tied to an anonymous player ID kept on your device and in our cloud save; keep your device backed up and use Settings → Save & account → Export save to move your colony.

2. Virtual items and Crystals

• Credits, Crystals, Super Taps, Uplink Tokens, Tile Swappers, buildings, upgrades, cosmetics, event tokens and all other in-game items ("virtual items") are a limited, personal, non-transferable, revocable license to use them in the game. You do not own them.
• Virtual items have no cash value. They cannot be exchanged for money or anything of value outside the game, sold, traded, transferred to another player or account, or refunded, except where the law or Apple's refund policy requires it.
• Crystals you buy do not expire while the game is offered. We may change how virtual items work, their prices in Crystals, or game balance, to keep the game fair and fun.
• Some Supply Crates contain random items. They can be bought only with Crystals, never directly with money, and the odds of each reward tier are shown before you open one.
• If we ever shut the game down we will give at least [60 days] notice in the game. Unused virtual items have no value when the game ends, except where the law requires otherwise.

3. Purchases

All purchases are made through the Apple App Store and charged to your Apple Account. Prices are shown in the game before you buy and include any taxes Apple applies in your country. Apple handles payment, refunds and receipts: request refunds at reportaproblem.apple.com. If a refund is granted, we may remove the items it covered from your colony. Use Restore Purchases (Settings → Purchases) to bring back subscriptions and permanent unlocks on a reinstall or another device; items you already used up, such as Crystals, live in your colony save instead.

4. Auto-renewing subscriptions

The current perks and the price for your country are shown on the subscription screen before you subscribe.

• Payment is charged to your Apple Account when you confirm the purchase.
• Auto-renewal: your subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.
• Manage or cancel at any time in your Apple Account settings: on iPhone or iPad open Settings → your name → Subscriptions, or the App Store → your profile → Subscriptions. Deleting the game does not cancel a subscription. Cancelling stops future renewals; you keep the perks until the end of the period you paid for.
• Free trials: some plans (currently Commander weekly) may offer a free trial to eligible new subscribers. Unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription and you are charged the price shown at the start of the trial. If you buy a subscription during a free trial, the unused part of the trial is forfeited.
• Changing plans: Commander and Governor are in one subscription group, so you hold one of them at a time. Upgrades take effect right away; downgrades and period changes start at your next renewal, as Apple handles them.
• Price changes: if the price of your subscription changes, Apple tells you in advance and, where required, asks for your consent before you are charged more.
• When a subscription ends its perks stop. You keep the items already added to your colony and the keepsake building earned with a paid period.
• Subscriptions are not available through Family Sharing. Daily Crystals and Super Taps are added automatically for each day your subscription is active.

5. Passes

The Governor Charter is a one-time purchase that gives Governor perks for 14 days and does not renew; buying it again adds 14 more days. The Expedition Pass unlocks the premium reward track of the live event running when you buy it and ends with that event.

6. Acceptable use

You agree not to:

• cheat, use bots or auto-clickers, modify the app or its saves, or exploit bugs to gain an advantage (please report bugs to us instead);
• manipulate leaderboards, referrals or purchases, for example with multiple accounts, fake invitations, chargebacks for items you received, or reselling accounts or items;
• reverse engineer, decompile or copy the game, or interfere with or overload our servers;
• pick a colony name that is offensive, hateful, sexual, impersonates someone, or contains personal information;
• use the game in breach of the law or of the Apple EULA.

7. Leaderboards and colony names

Your colony name, scores and colony snapshot are visible to other players. We check scores for plausibility and may remove scores, reset names, or hide players from leaderboards when we believe they break these terms. Sandbox and test purchases may exclude a player from leaderboards.

8. Online features and changes

The game can be played offline. Cloud save, leaderboards, colony visits, referrals, live events and purchase verification need an internet connection and may sometimes be unavailable. We update the game regularly, including over the air, and may add, change or remove features, events and content.

9. Ownership

The game, its art, audio, story and code belong to Multimode Technologies and its licensors. If you send us ideas or feedback, we may use them without owing you anything.

10. Suspension and termination

You can stop playing and delete the game at any time, and ask us to delete your data (see the Privacy Policy). We may suspend or end your access to online features if you seriously or repeatedly break these terms. Where the law requires, we will tell you why and you can contact us to appeal.

11. Disclaimers and liability

We work hard to keep the game running and your colony safe, but the game is provided "as is" and "as available". To the extent the law allows, we are not liable for indirect or consequential losses, for lost virtual items caused by events outside our reasonable control, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived, or liability that cannot be limited by law.

12. Governing law

These terms are governed by the laws of India (courts: [City for jurisdiction]). If you are a consumer living in the EU, UK or another country with mandatory consumer rules, you keep the protection of those rules and can bring claims in your local courts.

13. Apple

These terms are between you and us, not Apple. Apple is not responsible for the game, its content, maintenance or support, or for any claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you as they relate to the app.

14. Changes to these terms

We may update these terms. If a change is significant we will tell you in the game before it takes effect. Continuing to play after that means you accept the new terms.
